Background
The McCloud remedy gets rid of the age discrimination that was found in pension plans for public service workers, including the NHS Pension Scheme. The discrimination resulted from allowing older members to remain in their legacy (1995 or 2008) scheme rather than being moved to the 2015 Scheme when it was introduced. The remedy is made up of two parts:
Part 1
- closed the legacy public service pension schemes on 31 March 2022
- ensured equal treatment for all public service pension scheme members by moving all active members into the reformed public service pension schemes on 1 April 2022
Part 2
- returns members who moved to the 2015 scheme back into the legacy scheme for their pensionable service (‘remediable service’) effected by the discrimination during the remedy period, from 1 April 2015 to 31 March 2022, which is referred to as ‘rollback’
- offers a choice of whether to receive, legacy scheme benefits or 2015 scheme benefits for their remediable service benefits, both of which are payable from the legacy scheme
McCloud Rollback
The rollback of pension benefits into the 95/08 scheme for 2015 to 2022 (the remedy period), means that the pension growth during the remedy period will need to be recalculated. This could then have an impact on the member’s annual allowance calculations, so they will need recalculating too.
If you have overpaid annual allowance charges during the remedy period, then you should be able to claim a tax rebate via the tax system, as well as compensation for any overpaid tax that cannot be corrected via the tax system as a result of the statutory time limits for correction of tax in previous years.
